Can you help my friend, BRIAN here? I just found his plea - his note to me - in my FB acct and he is in a really bad sitch - worse than mine is.
This is what he said: BRIAN GAFFEN:
- I'm preparing for my jail sentence for non-payment of child support and I’ve never been in arrears in the 6 years I’ve been paying child support. Before my mother died in March 2009, I promised I’d use her life savings to fight for my boys in court to give them a father and also to make sure my 92 year old father was taken care of.
- I fulfilled both promises I made to her. A rogue Cook County judge has decided that the small inheritance I received from my mother was subject to child support. Inheritances are not earnings and, therefore not subject to child support. For 6 years, I fought for normalized visitation and spent hundreds of thousands of dollars on legal fees, much of it from my inheritance. Now the Cook County Court is getting a second bite of the apple as to whether I do indeed have visitation with my children.
- The recipe? Demand an exorbitant amount the judge knows I can’t pay so I will effectively lose my visitation. If I want to see my children again, I had 90 days to come up with the with the first ransom installment of approximately $17,000 due November 1st. and a total of $34,000 within a year.
- Also, my attorney withdrew from my case in that I owe him $25,000 so I've been representing myself and doing a poor job of it. Further, I also owe $14,000 to my ex-wife's lawyer. If I have any hope of paying these amounts, as a cab driver, I need to work weekends and it may take years to pay in full.
- As I look forward to spending my weekends in jail, my children once again are the big loser as they continue a life without their father. I'm reaching out to the Facebook community for pocket change to help me resolve these issues so I can concentrate on my top priority, parenting my children.
