In a nutshell, I’ve been ripped off TWICE via the Smithe Brothers (Walter E., Timothy J. & Mark of Smithe Brothers Custom Furniture) via TV Commercials they produced and aired on NBC/Chicago.

The local IP:  Intellectual Property Lawyers I contacted (since Friday, January 6, 2012 when the First Violation occurred) wanted either $40,000 upfront as a Retainer or $300 an Hour to take my Case, a Human Interest Story that applies to anyone who has ever penned a Single Word.  Chump Change for the Zuckerbergs or Gates, but not to me and most struggling Americans of Today. 

Being in ‘The News Biz’ as you are (and possibly a Writer in your own ‘Right’), you know how very important it is to protect your Words & Visions when it applies to Literature – American Literature – Chicago Authors’ Words & in particular and unique Cases as mine, because I’m a ‘Natural Born Writer’ and the only Person in History ever deemed as:

This is my Livelihood & Calling/Passion that will not be tampered with; overtly ripped off or consciously stolen, although they were -- not only ONCE, but TWICE, stolen by the Smithe Brothers for a Profit & Exposure without my Permission, Credit, Acknowledgment and Payment as its Creator and rightful Copyright Owner. 

This is what I do.  I will be 60 on August 9TH.  This is a monumental Year for my Creative Writings as I mark my 55TH Year in The Trade.

Why I am telling you this is because of your vested Interest in my Story, a Case Study that hinges on a Legal Case.  If abhorrent ‘Crimes Against Literature’ are happening to me, Violations (as these & similar ones) are happening to more and more People.  Since Intellectual Property Attorneys can’t be found to take my Case ‘on Contingency,’ my next Move and Maneuver is to present my Story to you so you,

(as of January 6, 2012 and then again to me on May 23-29, 2012).  Your Legal Team will be able to instantly see the Seriousness of this ongoing & repetitive Pattern that the Smithe Brothers exhibit, culminating into a Felony/Crime.  It is my wish and hope that NBC’s Legal Team can then take the appropriate Action that I cannot perform on my own. 

SO YOU WILL ALSO KNOWADDING FUEL TO THE FIRE:  From my Research and constant watching of your Programming on NBC, I believe the Smithe Brothers have ‘ripped-off’ Jerry Seinfeld’s ‘Bee Movie’ in October of 2007 and later, Jessica Sarah Parker’s ‘Sex in the City’ Franchise in 2008 via more of their ‘slapstick’ Pop Culture Takes.  I see a Pattern here.  Do you?  A pathological Pattern at that.

Evidently, from ‘Talk’ on the Internet, Facebook and Chatrooms, many other “Conscientious Observers’ (who are also watching NBC) feel the same way that I do.  The only Difference (and a vast one at that) between us is that I am the one they are ‘stealing’ Material from - not ONCE, but TWICE.

I love watching NBC.  I wake up early (circa 4 AM) to catch the latest Segments with Stefan, Daniella, Andy-on-The-Weather; while Mike Lorber tells us what’s happening 36,000 feet up and Matt Rodewald prepares us for Life (or Strife) up and down the Expressways.

Before starting the Day, like clockwork, I then listen to ‘The Today Show’ in New York City that turned 60 on Saturday, January 14.   2012 is my BBMY:  Big Banner Milestone Year, also…along with QE: Queen Elizabeth’s Coronation that dates back to 1952, a very Momentous Year at that!  In our own Individualistic Styles & Manners, We are and have laid the Foundation of what puts ‘The POP into POP Culture’ (as I call it). 

NBC Channel 5 TV Station constitutes a large Part of my DEET:  Daily Entertainment & Education Time (providing the DEETails  I need to know once I hit the ‘Outside Turf’).  Not only does your Programming help me on a Surface Level, but your Reporting aids me in my Evolutionary Growth as a Creator & Lifestyle Consultant.

THEREFORE, DUE TO THIS, I am sure you can see why I am not about to let greedy Corporate Businessmen make a bigger Name for themselves; fill more of their Coffers on the Fruits of my copyrighted Visions and Creativity; and misrepresent and misappropriate my Constructs using a reputable and internationally known Broadcasting System, NBC as their express Vehicle.

For many of you who are wondering:  It costs $4,000 a Day to rent the Batmobile that was used in the(ir) recent May 23-28, 2012 Commercial of which I was its Originator (of its 3 Scripts; Originator of the Concept & Liaison to introduce the 2 Parties [namely  Skip Haynes (living in Los Angeles) & the Walter E., Timothy J., & Mark  Smithe,  all residing in Chicago). Never having met, I, ADRiENNE SiOUX KOOPERSMiTH,  was the Catalyst that coalesced this TV Commercial and brought it to the TV Screens of Millions of Viewers in The Midwest (the Third Largest Marketplace in America) without COMPENSATION, PERMISSION, ACKNOWELDGEMENT and/or CREDIT. 

Yes, I do have all the Paperwork to substantiate that this Commercial is mine. As Financial Records prove:

The Smithe Brothers Furniture Empire netted $102,000,000 as of a Privco.com  2007 Statistic while Musical Earnings placed Musician/Songwriter/Composer, Skip Haynes between the $10,000,000 - $25,000,000 Bracket.  They could definitely afford my PRAM: Public Relations/Advertising/Marketing Services and all  pertinent Creative Fees attached to such a Televised Commercial.     

MY SPECIAL REQUEST:  Please take the appropriate Steps to see what you can do about this Endemic before it spreads further.  Copyright Infringement (along with the Crimes that it umbrellas as:  Conversion of Intellectual Property, Misappropriation of Material, Plagiarism and Piracy) are only the Tip of the Iceberg (as I am rapidly discovering). 

TURNING A LEMON INTO LEMONADE:   As you can well imagine, a Situation as this is (beyond) maddening; it’s illegal and should not be condoned or furthered on NBC.  But since most (if not nearly all of us are Writers to a certain Degree from scribbled Grocery Notes to award-winning Screenplays), the  Two (2) Platforms I am diligently working on will ensure Safety of our Written Words & Works  that spread the Message about how this ‘Copyright Infringement, et.al.’ has mushroomed out of Control.  Their Release is forthcoming. 

REFLECTING UPON THE LAST SIXTY (60) YEARS: 

On an ironic note, Ron Ron (a/k/a: Ron Reid, Jr.), a Video Producer from Tokyo with links to CNN and  one of my dearest Facebook Friends told me and I quote: 

be happy!! i heard this means your work is commercial. just go and continue writing. your valuable. and then hire a great lawyer as you threaten to sue the network for not checking liable if you think you need too. but you can be happy things are commercial for you… if i turn 60 and people are copying my stuff then i might be real happy. cause it shows you have the "RIGHT STUFF" still!! 



MY EVALUATION:  It’s reassuring to know that my FanBase & Friends (from both near and afar and as way-back as Grade School (as many  of my Classmates are now ‘tracking me on all of our Social Networks’) issue Comments like Ron Ron’s. 

Furthermore, by starting my own PRAM: Public Relations – Advertising – Marketing Company in 1979, I have influenced People who believe in the Quality of my Work & Writings that are seen as:

‘so commercial they should be ‘commercialized’ and converted into a TV Commercial’

that is later aired; attracting the Attention/Viewership that NBC possesses.  Being on-air for 60 Years of non-stop Televiewing using the most  popular Entertainment Format Culture knows, is applaudable.  Stealing the Material (from the Mouth of Chicago Local Artistry & Talent) that profits those Eleven (11) Designer Showrooms that the Smithe Brothers own is not. 

IN CLOSING:  By working together this Way, we can jointly help alleviate this growing Crime and set a Precedence to all other Programming Stations (TV, Radio & Internet) in our 21ST Century World.

ASK: I'm the "James" in the list. I'm curious why you believe that Smith's use of the creative is not an exception to Copyright Act by way of parody. If the parody exception is weakened the writers at SNL and just about every comedy act would be a CR violation.

Also, are you sure you have standing to sue? i.e. Who is the CR holder? My guess is that the creative you produced was "work for hire." Meaning that NBC, by example, owns the CR, not you.

Just curious.
